There are factors that are to be considered, including the type of property and who the owners of the property are.

Also, probate must be opened if the deceased person’s personal property holds a value of more than $75,000. If it is less than this amount, there is the possibility that the legal heirs may be able to claim items without probate court involvement.

Does Having a Will Avoid Probate?

It is possible to avoid probate with a will, but this is not always the case. Part of the probate process involves determining if the will is valid or not. In the event that the estate property needs to be distributed or taxes need to be paid, a valid will does not avoid probate. If there is no will, the courts will decide who receives the estate’s property and assets.
